0xBASE INTEL BRIEF
  • Advocate General opinion says Tyrol's night, sectoral, and winter truck bans at Brenner violate EU free movement.
  • Only the metering of 300 trucks per hour near Kufstein is deemed lawful.
  • Final ECJ ruling expected autumn 2026/early 2027; could set precedent for Alpine transit.

"The Advocate General of the European Court of Justice issued an opinion on July 16, 2026, stating that several truck driving bans imposed by the Austrian state of Tyrol on the Brenner motorways violate the EU principle of free movement of goods. The opinion concerns night, sectoral, and winter bans on the A12 and A13. Only the truck metering system (300 per hour) was deemed lawful. Italy had brought the case (C-524/24) in July 2024. The final judgment is expected in autumn 2026 or early 2027. The opinion could set a precedent for other Alpine transit corridors."
